Welcome to FunCards! These Terms and Conditions (the “Terms”) govern your access to and use of the FunCards service. By using FunCards, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use the service.

1. General Terms

1.1 Scope of Services: FuncCards provides users with virtual cards for online transactions. The service is intended for lawful personal or business use only.

1.2 Eligibility: To use the FunCards service, you must be at least 18 years old and capable of entering into a legally binding agreement. By using FunCards, you represent and warrant that you meet these requirements.

1.3 Registration: Users must create an account to access the FunCards service. During registration, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted through your account.

1.4 Changes to the Terms: FunCards reserves the right to modify or update these Terms at any time. If material changes are made, users will be notified through their registered email or account dashboard. Continued use of the service after the effective date of any changes constitutes acceptance of the revised Terms.

2. Definitions

For the purpose of these Terms, the following definitions shall apply:

“Account” means the user’s registered account with FunCards, which provides access to the service.

“Account Balance” refers to the total amount of funds available in a user’s account. A separate balance is issued for each available currency, including any transactions or fees, as displayed in the account dashboard.

“Decline Rate” refers to the ratio of declined transactions to successful transactions, expressed as a percentage.

“FuncCards” refers to the virtual card service provided by the company, including all associated services and features.

“Merchant Category Code (MCC)” means the four-digit code assigned to a merchant by credit card companies to classify the type of business.

“Prohibited Services” refers to any services that are illegal or restricted under applicable law or regulation. or otherwise disallowed by financial institutions, payment networks, or company policies.“

“Sanctioned Countries” refers to countries that are subject to trade or financial restrictions imposed by international regulatory authorities.

3. Prohibited Activities

3.1 Users are prohibited from:

• Using FuncCards for unauthorized cash withdrawal, cash recycling, or similar activities.
• Exceeding a decline rate of 30% (calculated as the ratio of declined transactions to successful transactions).
• Using FunCards to pay for services prohibited by applicable law or for transactions associated with restricted Merchant Category Codes (MCC).
• Sharing card details with third parties.
• Sharing access credentials to the FuncCards account with unauthorized third parties.
• Conducting transactions in countries subject to international sanctions.

3.2 Violation of any prohibited activity may result in immediate suspension or termination of your account, and forfeiture of any remaining balance to cover potential damages and administrative costs.

4. Fees and Charges

4.1 Card Issuance Fee: A one-time fee may be charged for issuing a new card, as specified in the account dashboard. This fee applies at the time of card creation and is non-refundable.

4.2 Penalty Fees: Additional fees may be charged for transactions declined due to insufficient funds or attempts to use FunCards for prohibited services.

4.3 Inactivity Fees: FunCards reserves the right to charge a fee for accounts that remain inactive for more than 90 consecutive days.

4.4 Foreign Exchange Fees: Transactions involving currency conversion may be subject to additional fees as specified in the account dashboard: these fees apply when the transaction currency does not match the currency of the account balance.

4.5 Microtransaction Fees: Transactions below the minimum amount specified by the service may be subject to an additional fee, as outlined in the account dashboard. This fee is applied automatically at the time of the transaction.

5. Account Suspension and Termination

5.1 FunCards may suspend or terminate your account under the following conditions:

• No successful transactions have been recorded for more than 14 consecutive days, and only declined transactions are reported.
• No transactions of any kind (including successful and declined) have been recorded for more than 90 consecutive days.
• Violation of any rules outlined in Section 3 (Prohibited Activities).

5.2 In the event of account suspension or termination, users will be notified via email or account dashboard. FunCards may retain any remaining balance to cover applicable fees and administrative costs.

6. Reinstatement of Account

6.1 Users whose accounts have been suspended may request reinstatement by contacting FunCards support. Reinstatement is subject to:

• Full payment of all outstanding fees and charges.
• Verification of compliance with these Terms.

6.2 FunCards reserves the right to deny reinstatement requests if the user has a history of repeated violations.

7. User Obligations

7.1 Users are responsible for:

• Ensuring sufficient funds are available for transactions.
• Maintaining up-to-date account information.
• Complying with all applicable laws and regulations when using FunCards.

7.2 Users must immediately notify FuncCards of any unauthorized access or suspected breach of their account.

8. Intellectual Property Rights

8.1 Ownership: All intellectual property rights in the FuncCards service, including but not limited to trademarks, logos, software, and content, are owned by FuncCards or its licensors.

8.2 License: FunCards grants users a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms.

8.3 Restrictions: Users shall not modify, copy, distribute, or reverse engineer any part of the FuncCards service without prior written consent from FunCards.

9. Privacy and Data Protection

9.1 Data Collection: FuncCards collects and processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms.

9.2 User Consent: By using the FuncCards service, users consent to the collection, processing, and storage of their personal data as described in the Privacy Policy.

10. Limitation of Liability

10.1 FunCards shall not be liable for:

• Losses resulting from unauthorized access to user accounts due to user negligence.
• Declined transactions due to insufficient funds or technical errors beyond the control of FuncCards.
• Penalties or legal consequences arising from the use of FunCards in sanctioned countries or for prohibited services.

10.2 To the extent permitted by applicable law, FunCards’ total liability for any claims under these Terms shall be limited to the amount of fees paid by the user in the preceding six months.

11. Indemnification

Users agree to indemnify and hold harmless FunCards, its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, or expenses arising from:

• Violation of these Terms by the user.
• Unauthorized or improper use of the FunсCards service.

12. Governing Law and Dispute Resolution

12.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus.

12.2 Dispute Resolution: Any disputes arising out of or relating to these Terms shall be resolved through negotiation. If the dispute cannot be resolved amicably, it shall be submitted to binding arbitration under the rules of the Cyprus Arbitration and Mediation Centre. The arbitration shall take place in Nicosia, and the language of arbitration shall be English.

13. Termination of Services

13.1 FunсCards reserves the right to terminate or suspend the service, in whole or in part, at any time, with or without notice, for maintenance, security, or other operational reasons.

13.2 Upon termination, users will no longer have access to their accounts, and any remaining balance will be subject to applicable fees and charges.

14. Miscellaneous

14.1 Entire Agreement: These Terms constitute the entire agreement between the user and FunсCards regarding the use of the service and supersede any prior agreements.

14.2 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver: Failure by FunсCards to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Force Majeure: FunсCards shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, natural disasters, government actions, or network outages.
